EU AI Act Transparency Rules Set To Apply From August 2

The EU AI Act transparency rules take effect from August 2, introducing new disclosure requirements for AI providers and deployers

July 30, 2026: Businesses using artificial intelligence tools in the European Union must comply with new transparency requirements from August 2, 2026, under Article 50 of the European Union Artificial Intelligence Act (EU AI Act). The rules require organizations to disclose certain AI-generated content, inform users when they are interacting with AI systems, and label AI-generated or AI-manipulated deepfakes.

We previously examined how marketing and sales technology vendors should prepare for the EU AI Act’s broader August 2 compliance deadline. The latest development brings that deadline into sharper focus, with Article 50 introducing specific transparency duties for AI interactions and AI-generated content. 

Ahead of the deadline, the European Commission published a voluntary Code of Practice on June 10, 2026, to help AI developers and businesses prepare for compliance. The guidelines outline approaches for marking and labeling AI-generated content, including technical methods for identifying AI-generated outputs. An independent explainer on Article 50 transparency obligations was also published on May 14, 2026, before the rules became applicable.

What the rules require 

The transparency requirements apply in four main situations: when AI interacts directly with people, when it generates text, images, audio, or video, when it is used for emotion recognition or biometric categorization, and when it creates deepfakes or AI-generated content related to matters of public interest.

For businesses, the rules do not ban generative AI content. Instead, they introduce disclosure requirements for specific AI applications. Companies using AI chatbots or virtual assistants must inform users they are interacting with AI, while organizations publishing certain AI-generated content must make that use identifiable.

Digital platforms have also introduced their own AI labeling approaches. Meta labels eligible AI-generated content across Facebook, Instagram, and Threads using technical signals and user disclosures, while continuing to allow creators and businesses to publish AI-generated material.  

The European Commission said its Code of Practice was developed with input from more than 180 stakeholders, including AI companies, researchers, public authorities, businesses, and civil society organizations. While following the Code is voluntary, compliance with Article 50 transparency requirements is mandatory.

Compliance penalties and industry response 

Under Article 99 of the EU AI Act, organizations that fail to comply with applicable requirements could face administrative fines of up to €15 million or 3% of their total worldwide annual turnover, whichever is higher. 

Industry response has been mixed. As of 30th July 2026, Reuters reported on Google’s plan to sign the EU AI Code of Practice, while Microsoft is also expected to participate. Meta has declined to sign the voluntary framework, citing legal uncertainty around parts of the broader AI Act. While the Code of Practice is voluntary, organizations remain subject to the mandatory transparency requirements under Article 50 of the EU AI Act. 

Why this matters

For B2B marketers and business leaders, the changes mean companies can continue using generative AI across marketing, customer communications, and digital experiences. However, organizations will need to build transparency measures into AI-driven interactions involving users in the European Union.
